Valid Reasons to Deny Visitation
Learn about the valid legal reasons for denying visitation rights and what circumstances may justify denying access.
When Can Visitation Be Denied?
While Texas law generally favors both parents having access to their children, there are circumstances where denying visitation may be appropriate.
Danger to the Child
If the child faces physical, emotional, or sexual abuse from the other parent, visitation can be denied or supervised.
Substance Abuse
Active drug or alcohol abuse that endangers the child's welfare can be grounds for denying or modifying visitation.
Mental Health Concerns
Severe untreated mental health issues that pose a risk to the child may warrant restricted visitation.
Court Orders Are Required
You cannot unilaterally deny visitation without a court order. Doing so can result in being held in contempt of court.
